Terms and Conditions

These Terms and Conditions (“Terms and Conditions”) form a legal agreement between you and HouseCallMD. Use of any service provided by HouseCallMD or its providers constitutes your acceptance of these Terms and Conditions and the HouseCallMD Privacy Policy.

Personal Information and privacy

Personal information means any information about a specific person that identifies their name, contact information, demographic information, any personal or protected health information. HouseCallMD follows US Dept of HHS (Health and Human Services) guidelines for Privacy Practices as detailed in our Notice of Privacy Practices.

Online Access

In order to use our online access,You will be asked to register an account and create login information, username and password. It is your responsibility to safeguard your information and to agree to notify HouseCallMD of any unauthorized use or suspected breach of security. HouseCallMD will not be liable for any malfeasance or claim resulting from unauthorized use of your account or registration information.

Prohibited Uses

Any use of HouseCallMD's services is strictly limited to providing non-emergent medical care to patients and their dependents or wards. Any other use, personal or commercial is prohibited Users agree to not transmit any unlawful, threatening or harmful text or images. Users agree to not allow any other person access to the system using their login or registration information.

Your Representations and Warranties

You declare that you do not have an emergency medical condition present. If you have an emergency, you are instructed to call 911.

In order to use HouseCallMD's services, you represent and warrant that you; are at least 18 years old; are located in the state of Washington; have the legal ability and authority to enter into these Terms and Conditions with HouseCallMD; verify your registration information is complete and accurate; will notify HouseCallMD in writing of any changes in registration information; and will comply with all applicable laws. A parent or guardian may request care for their dependent though HouseCallMD. Use of HouseCall MD constitutes an agreement to pay fees listed on the HouseCallMD website.

Termination

You may terminate these Terms and Conditions by ceasing to access the HouseCallMD website, notwithstanding any unresolved debts still owed to HouseCallMD. HouseCallMD may, in its sole discretion, terminate a user's access to services for any reason, without prior notice. These actions are in addition to any other legal right or remedy HouseCall MD may have available. Further, HouseCallMD shall not be liable to you or any third party for any such termination or discontinuance.

Modifications to these terms and conditions

HouseCallMD may in its sole discretion, without prior notice to you, revise these terms and conditions at any time. Should these Terms and Conditions change materially, HouseCallMD will update the Effective Date noted above and post a notice on the website. Amended Terms and Conditions will be effective as of the effective date unless otherwise stated. The notice of amended Terms and Conditions will also appear when you access the website. By accessing or using the website after such changes are posted, you agree and consent to all such changes.

Indemnification and limitation of liability

You agree to defend, indemnify and hold HouseCallMD, it's officers, directors, employees, shareholders, affiliates, third party contractors, agents, licensors and suppliers, harmless from and against any claims, actions or demands, losses, liabilities, damages, cost, expenses and settlements (including without limitation reasonable attorney and accounting fees), resulting from or alleged to have resulted from directly or indirectly, your violation of these terms and conditions.

HouseCallMD shall not be liable for any failure to perform its obligations where the failure results from any cause beyond HouseCallMD's reasonable control, including, without limitation, personnel issues, mechanical, electronic, or communications failure.

Law and jurisdiction

These Terms and Conditions are governed by the law of the State of Washington. The parties irrevocably submit to the exclusive jurisdiction of the courts of the State of Washington with respect to all matters and disputes arising from these Terms and Conditions.

Electronic Communications and Documents

This electronic document, and all other electronic documents regarding this agreement, medical care, privacy, permissory and consent agreements will be deemed to be “in writing”, and to comply with all statutory, contractual, and other lawful requirements for a written document. A printed version of these Terms and Conditions and any other notice, permission or consent given in electronic form shall be admissible in judicial or administrative proceedings to the same extent and subject to the same conditions as other such documents and records maintained in printed form.

You agree to receive SMS messages and phone calls from Housecall MD. These messages include information related to your patient care, appointment confirmation and scheduling. We will never share your phone number with any third party.

Consent for Treatment

I consent to allow the providers and employees of HouseCallMD to obtain information and ask questions regarding current medical status and history for myself, dependent or ward. I consent to appropriate medical evaluation in person or electronically, and medical tests as indicated to diagnose and treat relevant medical conditions. I have the right to discuss any recommended treatment or testing with the medical provider and to accept or refuse these treatments. I am encouraged to ask any questions about any concerns I have. I understand that if additional testing or invasive procedures are needed, I will be asked to read and sign additional consent forms. This consent is valid until it is revoked in writing.
